Atualizado até setembro de 2018!O Código Penal vigente no Brasil foi criado pelo decreto-lei nº 2.848, de 7 de dezembro de 1940 pelo então Presidente Getúlio Vargas, tendo como Ministro da Justiça Francisco Campos.
Apesar da criação em 1940 o atual Código só entrou em vigor no dia 1º de janeiro de 1942 (artigo 361).
O Código teve origem em projeto de Alcântara Machado, submetido ao trabalho de uma comissão revisora composta de Nelson Hungria, Vieira Braga, Narcélio de Queiroz e Roberto Lira.
Há referências históricas quanto a colaborações do Ministro Antônio José da Costa e Silva e, na parte da revisão redacional, de Abgar Renault, mas estes não faziam parte direta da referida comissão.
A interpretação do Código Penal à luz da Constituição Federal revela os seguintes princípios basilares: a legalidade, devido processo legal, culpabilidade, lesividade, proporcionalidade, individualização, humanização e valor social da pena, subsidiariedade, fragmentariedade.
Enfim, a lei penal brasileira é uma barreira de defesa do indivíduo em face do poder punitivo do Estado.
